The legal profession in Mauritius is split between solicitors (attorneys) and barristers. Our dispute resolution team brings both professions under one roof. They work together throughout all stages of the litigation process.

From the outset of every case, we ensure that we understand the commercial outcome that our clients want to achieve through the dispute resolution process. We identify the strengths and weaknesses of the case and discuss our proposed approach and strategy with our clients. We consider that it is important for the clients to understand the litigation process, timeframe and costs.

Our litigators have a solid reputation. They appear before all jurisdictions in Mauritius and on appeal before the Judicial Committee of the Privy Council. They are experienced in contractual disputes, debt recovery, shareholders’ disputes, directors’ liabilities, insolvency and investment disputes.

Recent work

  • Advising a Mauritius-based company on resisting potential action that shareholders or creditors might take to prevent the implementation of a debt restructuring plan sanctioned by a foreign court.
  • Acting for a private equity investment vehicle in a dispute relating to an outstanding loan given to a deceased shareholder and the company’s refusal to register the purported transfer of shares to the estate of that shareholder.
  • Acting for a real estate promoter in a dispute against a local bank regarding the enforcement of a performance bond.
  • Acting for the Mauritius Duty Free Paradise in a dispute against a local bank in relation to an alleged debt in the amount of MUR 40 million and attachment proceedings initiated by the bank for that sum.
